$480,000 for Wrongful Death

A waste disposal company agreed on March 28 to pay $80,000 to the estate of an apartment resident who died of complications after falling from a trash container platform. The settlement, the second in the case, brings the recovery to $480,000.

Patricia Whyte fell from a broken concrete platform and fracturer her ankle after she threw her garbage in a container at apartments owned by Garden Homes Inc on Dec 3, 2003. Ten days later, Whyte died of a blood clot caused by the fracture. The suit claimed that the Disposal company and apartment complex were liable for not repairing the platform.

$500,000 for Fatal Accident

A limousine company and a trucking company whose drivers allegedly caused a fatal accident agreed on Feb 14 to pay a $500,000 settlement. On May 4, 2004, a car owned by Joseph's Limousine Service of Whippany hit a vehicle on I-280 W in Essex County and crossed into the eastbound lanes. While trying to avoid the car, Ann Marie Sadavadge lost control of her car, which then stalled and was hit by a truck leased by Myers' Trucking Company of New York.

Sadavadge died almost instantly. She was unmarried and had no children. Lancer Insurance Company and Liberty Mutual Insurance Company will each pay $250,000.

$800,000 in Fatal Drunk Driving Crash

Justin King, 28 of Piscataway had been drinking at the Italian American Progressive League in South Plainfield when he crossed the center line and crashed into an oncoming vehicle. He and the private club he came from agreed to pay an $800,000 settlement.

The passenger of the other vehicle, Ronald Hurst, died a month later from the injuries he sustained in the crash. His driver, Mary Ludlow suffered wrist, knee and ankle fractures. King’s passenger, Shelley Kurilew, fractured her pelvis.

$2.85M for Wrongful Death, Runaway Wheel

The estate and survivor of a motorist killed when a truck's wheel crashed through his windshield settled a suit for $2.85 million last Wednesday. James Croce was driving with his wife on I 80 in Totowa on January 28 2005 when the left rear wheel of a tractor-trailer broke off, crashed through the windshield and struck his head. Lisa Zwier-Croce suffered minor injuries. Police concluded that the lug nuts were loosely torqued on the wheel on the trailer, owned by United Rentals Inc of Greenwich Conn.

The suit alleged that the trailer's manufacturer, Norbert's Mfg. Co. of Glenboro, Manitoba, and its distributor, Crown Construction Equipment of Winnipeg, Manitoba, failed to provide notice of the proper level of torque, and that United was negligent. Zwier-Croce also sought recovery for bystander trauma.

After a settlement conference Wednesday with Passaic County Superior Court Judge Thomas Brogan, United agreed to pay $2.1 million and Norbert's and Crown agreed to jointly pay another $750,000.

$3M for Medical Malpractice, wrongful death

An Essex County jury on June 30 awarded $3 million to a widow who blamed her husband's death on hospital doctors. Doctors treating William Clark for orthopedic and lung injuries from a truck crash failed to properly insert a naso-gastric tube to drain fluid from his stomach. The doctors mistakenly believed Clark did not need the tube and he eventually aspirated the fluids and choked to death while unattended.

The jury assigned 49 percent of the liability to junior resident Thomas Chiodo and 51 percent to senior resident Dr. Racquel Forsythe. It awarded widow Dorothy Clark $2 million for her husband's pain and suffering and $1 million for financial losses.

The defense presented evidence that there was no need for the tube and that Clark died of cardiac arrest. A resuscitation effort caused the fluid buildup in the lungs.

$6.3M in Wrongful Death

A Somerset County judge on July 1 awarded $6.3 million to a Pennsylvania man for the wrongful death of his mother by his divorced father. Roy Rambo was found guilty of murdering his ex-wife, Linda Rambo, during an argument at his Pohatcong Township dental office on Aug 16, 2002. He was found to have shot her in the back with an automatic pistol and then to have pummeled her with the gun's butt.

She was 47 years old at her death. Rambo is serving a 40 year prison sentence. He did not have a defense lawyer in the civil case. Superior Court judge Harriet Derman awarded $310,000 for wrongful death, $1 million for pain and suffering, and $5 million in punitive damages to the couple's son, Bruce, 31, who paints houses and does odd jobs in the Easton, PA area.

Bruce Rambo may be able to collect as much as $2 million from Roy Rambo's assets, which include stock investments, substantial land and a farmhouse in New Jersey and land in North Carolina.

$525,000 for Fatal Accident

On June 2, 2005, $525,000 was awarded to the parents of a 21-year-old bicyclist found to have been dragged to death by a truck. Alexis Serrato was cycling on Morris Avenue to class at Kean University on Oct. 21, 2002 when the truck hit him and continued for about 270 feet before stopping.

The truck was driven by a delivery man for B&B Best Buy Foods and was making its rounds. The plaintiff argued that it was the dragging caused by Carr’s inattention that killed Serrato, who died shortly after the accident. Witnesses said they screamed and waved to get Carr’s attention as Serrato clung to the bumper. The jury found both sides at fault due to Carr’s inattention and Serrato for having veered into the crosswalk.

$2.8M for Fire Death

$2.8M was awarded to the family of a fallen firefighter whom claimed that his death was caused by flaws in his protective clothing. In a house fire on January 1, 2001, James Heenan suffered burns on over 80 percent of his body and died about three months later.

The suit claimed that the burns were caused by steam generated by moisture trapped between the layers of protective material in his coat and pants. The plaintiff cited a study commissioned by the International Association of fire Fighters that showed the fabrics at issue broke down under certain conditions.
