$3.5M to Injured Down’s Syndrome Passenger

$3.5M was awarded to a passenger who was injured in a van collision with a truck. On February 29, 2001, a van operated by GST of Southampton strayed into the oncoming-traffic lane on Main Street in Wrightstown and collided with a truck, causing severe head, face and leg injuries to Barbara Green.

Green suffered broken teeth, a severed tongue and a crushed larynx and will have to breathe through a tracheal tube for the rest of her life. A defense expert also stated that people with Down’s Syndrome have shorter than average life expectancies.

Green will receive $2.5M in cash and the remain $1M will purchase an annuity under the settlement reached after two conferences.

$658,333 for Auto Injuries

A Hudson County jury on May 12 awarded $658,333 to a Union City woman for injuries suffered in a two-car accident. Dilia Palencia Rodriguez was stopped at an intersection in West New York on June 17, 2001 when her car was hit from behind. She suffered herniated discs and a torn ligament in her right knee.

Allstate Insurance Co. the carrier for the other driver, Margarita Guerrero of West New York, did not contest liability but argued that Rodriguez did not meet the verbal threshold because her injuries were not permanent. But Walden demonstrated permanency with evidence that Rodriguez had to quit her job as an assistant city clerk, move to an apartment without stairs and abstain from church activities.

$1M for Hotel Slip and Fall

A Middlesex County jury on May 11 awarded $1.04 million to an East Brunswick woman who broke a hip slipping on ice at a Poconos hotel. On Feb 8, 2002, Nancy Pindilli parked next to a curb at the Poc-Mont Resort & Conference Center in Bushkill, PA and proceeded to walk across a snow-covered lawn where she fell because there was no sidewalk.

Photographs were shown of other guests' cars parked at the same spot, to prove pedestrian traffic was foreseeable. Pindilli was seen liable for parking the left side of her car at the curb and wearing high heels. Further, she had walked in the same spot before and so was familiar with the conditions.

Pindilli required replacement of her right hip joint and implantation of three pins in her right femur. She could not return to work as an ultrasound technician.She can now only perform sedentary work at lower wages.

$2.25M for Fall From Roof

A carpenter disabled in a 32 foot fall from a Brigantine beach house roof during prehurricane conditions agreed on May 16 to accept $2.25 million to settle his injury suit. Sean Lee alleged that the defendants failed to ensure that he use fall protection equipment in ordering him to sheath the roof while Hurricane Dennis was headed north from North Carolina in September 1999.

The Atlantic County case settled halfway through trial in Superior Court Judge Daryl Todd's courtroom. The accident caused a burst fracture of his first lumbar vertebrae and left him with erectile dysfunction and no control of his bladder and bowels. They placed the current value of his loss of income at $575,000 and his medical expenses at $232,000.

$2.9M to Bus Passenger

A Passaic County jury last Wednesday awarded $2.9 million to a bus passenger injured when a tire came loose from a car on Route 17 in Paramus and slammed into her window. The impact of her head with the window hurt her eyes so badly that she, Winsome McPherson, is legally blind.

Evidence showed that new tires had been installed on the car 69 days before the December accident. A witness for the installer testified that shop procedures guaranteed proper mounting. But Stone's evidence showed the lug nuts were not inspected for wear and the shop did not use a torque stick that would have ensured a tight fit. The jury returned a no-cause against the driver of the car, Louis Dolfinger, assessed 70 percent of the liability on tire installer, Mavis Discount Tires of New York and found the bus operator, Coach Leasing Co., a subsidiary of shortline of Mahwah, 30 percent liable.

$577,000 for Truck Accident Injuries

A trucking company paid $577,000 on May 10 to a Marlton man for injuries allegedly suffered in an automobile collision. On March 20, 2001, Brian Baldwin, driving a pickup truck on Crescent Road in Voorhees, was broadsided by a dump truck that went through a red light on Route 73. Later that day, Baldwin went to the emergency room of Virtua West Jersey Hospital complaining of neck and shoulder pain. He was X-rayed and sent home with a pain killer and muscle relaxant, but his regular doctor later diagnosed herniated neck discs.

After two years of manipulation, physical therapy, and epidural injections, his discs at C-5-C6 and C6-C7 were fused and a metal plate and screws were inserted. Baldwin still has some pain and limited neck motion. The dump truck was owned by Bogey's Trucking of Brooklawn and driven by its employee.
